Question: Asalaamualaykum, What is the Hukm for wearing clothes, for instance T-shirts with pictures of living creatures on it?

In Sahih Muslim, it is related that the Prophet Muhammad (upon him be peace) said, "Those who make pictures/depictions, they will be punished on the Day of Judgement." Commentating on this hadith, Imam Nawawi said that to create pictures of animilia is absolutely unlawful, it is a major sin.

Making exclusions from this text's generality is found elsewhere as well, like in the case of children's toys. The Prophet (upon him be peace) allowed 'A'ishah to play with them.

(Note: in many fiqh books, the toys are mentioned specific to girls. While in Tuhfat al-Habib 3/458, Bujayrimi mentioned that boys are included too.)

Shaykh al-Islam Siraj al-Din al-Bulqini made an exception for when that picture is used for the purpose of branding, in which case it is allowed. There is a difference from amongst the Shafiyyah on if this case should be included under the generality of the prohibition or excluded. According to Bulqini it is excluded. In Hashiyat al-Jamal 3/26, this is related from Ramli too. And thus, a picture used as a brand on a garment one owns, this garment would be allowed.

A photo t-shirt with a picture of an animal on it would not be allowed.
